Diversified Consultants was an active debt collection company headquartered in Jacksonville, Florida.

The company was established in 1993 and licensed by the Department of Financial Services in Tallahassee, Florida along with the Florida Office of Financial Regulation.

However, according to their listing on the Better Business Bureau, the company is no longer in business.

Their former website doesn’t seem active and when I tried to call the numbers listed on their BBB profile they were out of service.

We figured what likely happened was that the company merged with another debt collection agency or changed its name.

I was able to call and confirm that Diversified Consultants, Inc. has now become ERC Collections which stands for Enhanced Recovery Company.

Still, if you have unpaid debts like a cell phone service bill, utility bill, or other loans from previous years that have gone to collections, Diversified Consultants, Inc. may still show up on your credit report.

Generally, companies like Diversified Consultants, Inc. will aggressively attempt to collect your debt by making phone calls, filing a collection notice on your credit report, or possibly even filing a lawsuit against you.

  1. A debt collector can’t call you before 8 am and after 9 pm. 

  2. They can’t call you while you’re at work if they know your employer doesn’t approve of the calls.

  3. Collectors can’t harass you or lie to you when trying to collect a debt.
  4. They must stop calling if you request in writing that they only contact you by mail.

It can be a relief to finally get a debt collector to stop calling. However, if the debt they’re reporting is valid and on your credit report, you still need to take steps to settle the account and remove it.

Here are some strategies to help you push back against Diversified Consultants and get the collection removed from your credit history.

Ask Diversified Consultants, Inc to Verify the Debt

The next time you talk to Diversified Consultants (now ERC Collections), be sure to ask them to verify your debt.

Legally, they should have done this already since debt collectors are required to send you documents to verify the debt within 5 days of contacting you. 

Make sure you advocate for yourself since some companies tend to gloss over this step and you want to make sure the debt they are reporting belongs to you.

In addition to validating the debt, Diversified Consultants must also prove that they are authorized by your original creditor to collect the debt.

If you don’t respond within 30 days of Diversified Consultants contacting you, they will assume that you are the legal owner of the debt and they have the right to collect it. 

Even if you request validation after 30 days, you still have the right to do so to verify that the debt is truly yours.

It’s not uncommon for debt collectors to make mistakes regarding who the debt belongs to.

There are many lawsuits against debt collection agencies who reported a collection for the wrong person who paid the bill just to avoid the bill staying on their credit report. 

The safest way to request debt verification is by mail. Get everything in writing! Be sure to call Diversified Consultants and ask for the proper mailing address to send your request to.

File a Dispute If Your Debt Isn’t Validated

If Diversified Consultants is unable to verify the debt or made an error when reporting it, you can file a dispute with the three major credit bureaus. 

You have a right to file a dispute according to the Fair Credit Reporting Act (FCRA) if the debt is left unverified or you find an error.

You can file a dispute by phone, online, or by mailing a request in writing.

Doing so will result in an investigation where Diversified Consultants will either need to validate the debt or get it removed from your credit report. 

While the FTC clearly outlines how to file a credit dispute and how to contact each credit bureaus, the process may become more complex and you may want to hire a legitimate credit repair service to help you.

Keep in mind that if the debt is in fact yours and was reported accurately, you shouldn’t attempt to file a dispute because it won’t help you. Instead, consider this next step.

Negotiate a Pay For Delete Agreement

Realize that a collection account can stay on your credit report for up to 7 years even if you pay it off.

This is why simply agreeing to pay off the account won’t be in your best interest if Diversified Consultants, Inc has already reported your debt to the credit bureaus. 

Instead, see if you can negotiate a pay for delete agreement.

Just as it sounds, a pay for delete agreement is a settlement option where you agree to pay a certain amount or percentage of the debt balance and collection agency will then remove the negative remark on your credit.

Some companies may claim a pay for delete agreement is against their policies but you’ll want to push back a little and let them know that you’re interested in settling the debt and getting it removed from your credit report. 

You can attempt to negotiate on your own and utilize some of these pay for delete letter templates.

Or, you may find more luck with hiring a credit repair company to negotiate on your behalf.

According to Credit Glory, getting a collection account successfully removed from your credit history may result in a credit score gain of up to 150 points so it’s worth a try.

Other people have been able to successfully get negative remarks removed from their credit and lived to tell the tale so don’t give up.

Just be sure to follow through and request and get it in writing if Diversified Consultants agrees to remove the negative mark from your credit report once a settlement has been reached.

Diversified Consulstants, Inc. Lawsuit

Debt collection agencies do have the option to file a lawsuit against you in an attempt to collect on the debt you owe.

In the event of this happening, you must respond to the lawsuit or the judge could file a summary judgement against you. 

This would mean you MUST pay off the debt and payments could even be taken directly from your bank account. 

The odds of Diversified Consultants filing a lawsuit against you are slim at best so that is a relief.

With Diversified Consultants now becoming ERC Collections, this agency does not use this technique to collect debt.

Still, lawsuits are expensive and you’ll want to avoid one at all costs.

Be proactive about requesting validation for your debt and negotiating a settlement to avoid getting to this point.

Finding out that an account has gone to collections and is now on your credit report can cause a lot of stress and overwhelm.

Know that you have legal rights to validate the debt and shouldn’t be harassed with phone calls by companies like Diversified Consultants non-stop.
